The games are intended to be opened, controlled, and supervised by a teacher, parent, coach, or other responsible adult. They are not designed as independent accounts or online services for children.
1. Acceptance of these terms
By accessing or using the arcade, you agree to these Terms of Use. If you do not agree, do not use the site. These terms apply to the arcade, its games, teacher guides, text, graphics, artwork, audio effects, and related materials.
2. Permitted use
You may use the public arcade and teacher guides for personal, educational, classroom, school, camp, coaching, or supervised group use. You may share a link to the public website with other educators and families.
You may not copy, sell, sublicense, redistribute, repackage, remove branding from, or host the game files or teacher guides on another website or platform without written permission. You may not use the materials to create a competing paid or free product.
3. Safety and supervision
The supervising adult is responsible for deciding whether a game is appropriate for the participants, room, equipment, accessibility needs, and applicable school or facility rules.
- Use walking rather than running unless a qualified supervisor has deliberately chosen a safe space for more active movement.
- Use soft, classroom-safe equipment for passing or throwing games.
- Keep pathways and accessibility routes clear.
- Stop or modify a game immediately if participation becomes unsafe or unsuitable.
- Follow all school, board, organization, facility, and local safety requirements.
4. Student information
Do not enter sensitive or confidential student information. When a roster is needed, use the minimum information necessary, such as first names, initials, nicknames, or non-identifying labels. Information saved by a game is intended to remain in the browser on the classroom device, as described in the Privacy Policy.
5. Game results and educational use
Randomized outcomes are for recreation and classroom participation. They are not assessments, diagnoses, disciplinary findings, or evidence of a student’s ability, character, behaviour, or entitlement to a reward. Teachers remain responsible for all instructional, supervisory, safety, accessibility, and classroom-management decisions.
6. Availability and changes
The games are provided on an “as available” basis. Features, rules, names, links, and availability may change. The Fixes Program does not promise uninterrupted access, compatibility with every device or school network, or permanent storage of local scores and rosters.
7. Disclaimer
To the fullest extent permitted by law, the site and materials are provided without warranties of any kind, whether express or implied. Use of the activities is at the supervising adult’s discretion and responsibility. Nothing in these terms excludes rights or remedies that cannot legally be excluded.
8. Limitation of liability
To the fullest extent permitted by law, The Fixes Program and its creator will not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of—or inability to use—the arcade. Any liability that cannot legally be excluded remains limited as permitted by applicable law.
9. Intellectual property
Unless otherwise stated, the arcade, source code, game designs, teacher guides, artwork, The Machine character, logos, and written content are owned by Christopher Allen / The Fixes Program. The names and branding may be protected by copyright, trademark, and other laws. Use of the public site does not transfer ownership.
10. Governing law and contact
These terms are governed by the laws applicable in Ontario, Canada, without limiting any mandatory consumer rights that apply in another jurisdiction.
